Vaccine Immunity from Lawsuits 2005 to 2024
You can’t sue Pfizer or Moderna if you have severe Covid vaccine side effects. The government likely won’t compensate you for damages either
CNBC December 2020
KEY POINTS
- The PREP Act signed in 2005 gives Pfizer and Moderna sovereign immunity from liability if something goes wrong with their vaccines, Specifically 42 U.S. Code § 300aa–22 – Standards of responsibility; You can’t even try to sue them until the Prep Act expires in 2024.
- Even the government program that’s suppose to provides benefits to people suffering from severe adverse effects has compensated only 5% of claimants (just 30 people in its entire history)
Under the Americans with Disabilities Act workers who don’t want to be vaccinated for medical reasons can request an exemption. If taking the vaccine is a violation of a “sincerely held” religious belief Title VII of the Civil Rights Act of 1964 can be used to opt out.
If you can’t get an exemption employees may have some legal recourse if they suffer debilitating side effects following a mandated Covid vaccination.
